BRIEF DESCRIPTION

This Holding is situated just to south of the rural village of Lerryn. The fields are generally level or gently sloping. At the present time, all of the land is in pasture, although some of the fields are suitable for cropping if required. Included in the Lease are farm buildings as follows: Cattle Shed - 31.53 x 8.64 (103’4” x 28’3”) with covered feed passage adjoining. Covered Yard 1 – 22.87 x 13.55 (94’7” x 44’4”). Covered Yard 2 – 19.33 x 18.15 (63’4” x 59’5). Pole Barn. Access to the land and farm buildings is via the private entrance lane shown coloured yellow on the attached plan and the public road. An ordnance extract is attached to our details showing the extent of the land edged red.

FARM BUSINESS TENANCY

The land is to let under a three year Farm Business Tenancy from the 29th of September 2020. A copy of a draft Farm Business Tenancy Agreement is available for inspection at the Agents office during normal business hours. The Landlord will be responsible for paying the costs of preparing an appropriate Farm Business Tenancy Agreement subject to the Tenant contributing £200 + VAT towards these costs.

REPAIRS

The Tenant will be obliged to keep the property in repair. The property is to be left in no worse a condition than at the commencement of the Tenancy.

ASSIGNMENT/SUB-LETTING

Not permitted.

USE

The land is currently all pasture although some of the fields could be broken if required.

SERVICES

A mains electricity supply is connected to the farm buildings and borehole. There is a private borehole water supply to some of the buildings to the all of the enclosures. The Tenant will be liable to pay for the electricity supply for the borehole and farm buildings. In addition, the Tenant will be required to pay half of the maintenance costs in respect of the borehole water supply which will be shared with the Landlord who will continue to live in the farmhouse.

RIGHT OF WAY, EASEMENTS AND WAYLEAVES

The land is let subject to all existing Wayleaves, Easements and Rights of Way, public and private whether specifically mentioned or not. The Landlord will retain the benefit of all Wayleave payments in respect of any apparatus situated on the land. No public rights of way are known to cross the land.

ENVIRONMENTAL SCHEMES

The land is not subject to any Environmental Stewardship schemes. Entry of the land into any schemes will be at the Landlord’s consent which will not be unreasonably withheld.

BASIC PAYMENT SCHEME

The BPS Entitlements will be transferred to the Tenant to be held in trust for the Landlord. The Tenant to make a claim each year under the Basic Payment Scheme and to pay the Landlord an additional rent representing the amount of the Basic Payment received by the Tenant from the Rural Payments Agency in relation to the property. The additional rent shall be payable within fourteen days of receipt by the Tenant together with copy documentation to confirm the amount.

VAT

No VAT will be charged in addition to the successful rent tendered.

DESIGNATIONS

The land is not known to be within any designated areas.

RENT

The prospective Tenants to submit their tender on the attached form on or before 12 noon, Friday 21st August 2020. The highest nor any tender will necessarily be accepted. The successful applicant will be notified on or before Friday, 28th August 2020.
